Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrooVote platform operated by Troofox Solutions Private Limited ("we", "our", "us") at troovote.in. By registering or using the service, you agree to these Terms.

1. The Service

TrooVote is a SaaS platform that enables communities, associations, companies, and organizations to create and run secure online elections and polls. Features include private voter lists, OTP-based voter authentication, live result monitoring, election agency management, and audit-ready reports.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use this service. Organizations using TrooVote must ensure their use of voter data complies with all applicable laws.

3. Subscription and Billing

• Plans are based on the number of voters for each voting event.
• A free tier is available for small votings up to the configured free voter limit.
• Subscriptions for additional voter capacity are billed per event as per current pricing.
• Refunds are not provided for unused voter capacity; write to us within 7 days of a charge for billing disputes.
• Prices are subject to change with 30 days notice.

4. Acceptable Use

You agree not to use TrooVote to:

• Conduct fraudulent, manipulated, or coerced elections.
• Publish illegal, harmful, or defamatory content.
• Infringe any intellectual property rights.
• Upload voter data you do not have the right to use.
• Distribute spam, malware, or phishing content.
• Attempt to reverse-engineer, scrape, or disrupt the platform.

5. Your Content and Voter Data

You retain ownership of all content you create, including voting configurations and voter lists. By using TrooVote, you grant us a limited licence to host, process, and deliver that content to facilitate your voting events. We do not claim ownership of your content.

You are solely responsible for ensuring that any voter personal data you upload complies with applicable data protection laws, including obtaining any necessary consents from voters.

6. Election Agencies

Organizations may engage election agencies through TrooVote to manage their voting events. Agency relationships are managed within your workspace. You are responsible for authorizing the appropriate level of access for any agency you engage.

7. Service Availability

We target 99.5% uptime. We may perform scheduled maintenance with advance notice. Unplanned outages will be communicated via the platform or contact email. We are not liable for losses arising from downtime beyond the value of the subscription.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity. You may stop using the service at any time. Upon termination, your published votings will become inaccessible.

9. Intellectual Property

All platform code, UI, branding, and documentation are the intellectual property of Troofox Solutions Private Limited. You may not copy, reproduce, or create derivative works without written permission.

10. Limitation of Liability

To the maximum extent permitted by Indian law, Troofox Solutions Private Limited is not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.

12. Changes to These Terms

We may update these Terms with 30 days notice posted on troovote.in. Continued use after the effective date constitutes acceptance.
